SHIPPING, PAYMENT & AUCTION POLICIES
Please read the following "Terms of Sale" carefully. Your submission of bids in this auction constitutes your acceptance of these Terms.
SHIPPING
1. No property will be released until payment in full has cleared. Any expense related to packing, shipping and insurance (including reimbursement for damage or loss) of purchased lots is the responsibility of the Bidder.
2. Bidder is responsible and free to select any shipper, and for insuring the shipment in transit. Once an item has been picked up or released to a shipper, it is no longer covered under the insurance of Himalayan Specialties.
3. When you have made arrangements with a shipper, please email us or fax us authorizing us to release your property to that person or company. We require a written authorization from the Bidder to release property to any third party.

4. We offer in-house professional packaging and shipping for selected items, principally smaller items. If we can ship, we will include the cost of shipping on the Invoice you will receive. If we ship, please allow five (5) to ten (10) days for shipment from the time we receive payment.
If we can't ship (or if you prefer your own shipper), please contact us for the shipping arrangements as we do have a list of recommended third party shippers to assist you in shipping (see below).
5. We can recommend 4 local shippers. The following recommendations are for convenience only. We do not accept liability for any shipping recommendations.

5. For shipments outside of the USA, customs and duties may apply upon entry into said country; this fee, if any, is the Bidder's responsibility. Also, please be aware that Himalayan Specialties will NOT falsify customs value on any international shipments what you pay is what we declare, no exceptions. There are a small number of international countries we cannot ship to. If you have questions about this, please inquire BEFORE bidding.
6. Paid-for merchandise must be collected by the Bidder or an authorized representative no later than ten (10) business days following the date of the auction. Any merchandise remaining after this period will be subject to a storage fee of $10 per lot/per day, plus a one-time fee of $25 per lot if the property is moved to off-site storage. Please note that responsibility and all liability of items as well as safe delivery are assumed by the carrier, shipper, Bidder, agent or packing company upon acceptance of merchandise. Bidder will not hold Himalayan Specialties liable for any damage or loss after merchandise has been released from our possession. Note, Himalayan Specialties takes no responsibility for any acts or omissions of any of the third-party shippers.
PAYMENT
1. An Invoice will be furnished to the Bidder at the end of the auction through the Live Auctioneers Platform. Payment is due upon receipt of the Invoice and must be made in U.S. Funds. Bank transfer is the easiest way to pay.
Payment for international Bidders is due by bank wire. We will provide you with the bank wiring instructions when your invoice is emailed to you. Domestic Bidders choosing bank transfers should contact us for the bank details after securing your purchase.
Payment may also be made via any method acceptable through LiveAuctioneers Payment Platform, including any major credit cards, PayPal (for international Bidders only) and ACH by clicking the 'Pay Now' button on your LiveAuctioneers Invoice. Also acceptable are Cashier's Check, check or cash.
Credit Card payments can be used for invoices which are $30,000 or less, and payments over $30,000 must be submitted by wire transfer.
If you haven't made timely payment arrangements and have a credit card on file with LiveAuctioneers, it will be automatically charged seventy-two (72) hours after you receive your Invoice.
2. If payment is made through LiveAuctioneers Payment Platform, the Bidder will be charged an additional 3% fee. If payment is made by bank transfer, Cashier's Check, check or cash there is no additional charge. Checks will not be deemed to constitute payment until cleared.
3. In the event a successful Bidder fails to make timely payment arrangements within seven 5 days of the Invoice Date, Himalayan Specialties reserves the right to (a) re-sell the merchandise, and Bidder agrees to pay for the reasonable cost of such a sale and to pay any difference between the resale price and the previously successful bid, together with any incidental costs of sale and disbursements; or (b) collect the Bidder's Premium and a Restocking Fee of 35% from the Bidder. If necessary, we will do so through legal means. And all legal fees and any associated fees incurred will be borne by the Bidder.
4. If the auction invoice is not paid for in full when due per invoice terms, including any applicable credit card processing fees, the unpaid balance will bear interest at the highest rate permitted by law until paid in full. If the matter is referred to an attorney for collection, Bidder agrees to pay all reasonable attorney fees, court costs and other collection cost incurred by Himalayan Specialties to collect past due invoices and that the services of process by certified or registered mail, return receipt requested, shall be sufficient to confer jurisdiction over Bidder.
TERMS
1. GENERAL
a. All items in this auction have been legally acquired, and are legal to sell.
b. By Bidding, you understand that any Bid you submit can and will be regarded as the Purchase Price Bid for a particular Lot; accordingly, your Bid constitutes a legally binding agreement to purchase the Lot in accordance with your Bid, if accepted by the auctioneer.
c. By bidding in this auction, the Bidder personally guarantees payment. The auctioneer has final discretion in all matters. In case of dispute, the lot(s) in question may be resold. Lots will be sold in their numerical sequence unless the auctioneer directs otherwise.
d. Himalayan Specialties, at its discretion, reserves the right to refuse participation in this auction by any Bidder, whether on premises, participating on-line, by telephone, or through absentee bid.
e. We may, in our sole discretion, withdraw a lot from auction at any time prior to or during the sale and shall have no liability to you for our decision to withdraw.
f. If the auctioneer determines that any opening or later bid or any advance bid is not commensurate with the value of the Property offered, he may reject the same and withdraw the Property from sale.
2. WARRANTIES & GUARANTEES
a. Though all description and commentary are believed to be correct, neither the auctioneer nor the consignor makes any warranties or representations of any kind with respect to merchandise. Our description of a lot, any statement of a lot's condition, and any other oral or written statement about a lot such as its nature, condition, artist, period, materials, dimensions, weight, exhibition or publication history or provenance are our opinion and shall not to be relied upon by you as a statement of fact.
b. The physical condition of lots in our auctions can vary due to age, normal wear and tear, previous damage, and restoration/repair. Any reference to condition in a catalogue description or a condition report shall not amount to a full accounting of condition and may not include all faults, inherent defects, restoration, alteration, or adaptation. Likewise, images in our catalogue may not depict a lot accurately, as colors and shades may appear different in print or on screen than on physical inspection.
3. AS IS. All lots are sold "AS IS" and ALL SALES ARE FINAL. There are NO RETURNS and NO EXCEPTIONS.
4. PRICE ESTIMATES. Estimates of a lot account for the condition, rarity, quality, and provenance of the object and are based upon prices realized for similar objects in past auctions. Neither you nor anyone else may rely on our estimates as a prediction or guarantee of the actual selling price of a lot or its value for any other purpose. Estimates do not include the Bidder's Premium, any applicable Taxes, and any other applicable Charges.
HIGH and LOW ESTIMATES are provided for each lot for reference only. The actual selling/hammer price may be higher or lower based on Bidder demand.
5. RESERVES. A reserve is the confidential minimum price established by Himalayan Specialties and the consignor. The reserve will never exceed the low estimate of the lot. Most lots have a confidential reserve, and the lots with reserve prices will be sold to the highest Bidder if the bid is equal to or greater than the confidential reserve.
6. BIDDER'S PREMIUM. A 20% Bidder's Premium will be added to the final price of each lot purchased through Himalayan Specialties and will be paid by all Bidders without exception.
7. SALES TAX. Items delivered or shipped outside of CA (United States or International) may be subject to sales tax. Please see the following for more details. If you are tax exempt, you can submit your tax-exempt certificate to prevent the collection of tax. Learn more about tax-exemption. For items received in California, appropriate California Sales Tax will be added to all invoices, unless a valid CA seller's permit is on file with Himalayan Specialties prior to any bidding in the auction.
8. ONLINE BIDDING. Himalayan Specialties accepts no liability for any failure or delay in executing bids or any errors contained in bids placed via any online bidding service, including but not limited to LiveAuctioneers. The user of any online bidding service indemnifies and holds Himalayan Specialties and its consignors harmless against any claim arising out of or resulting from your use of any online bidding service, including all losses, damages, liabilities, and all fees (including attorney's fees), costs, and expenses incurred in connection with any claim. Without limiting the foregoing, we accept no liability for any failures, delays or errors caused by interruptions in the availability of the online bidding service or any errors or defects in their content or functionality, any software and/or hardware defects (whether yours or ours) and/or any internet connection problems (whether yours or ours); and we do not represent or warrant that the online bidding service will be error-free. Under no circumstances, including, but not limited to, negligence, will we and our sellers be liable for any damages, lost profits or any special, incidental, or consequential damages that result from the use of, or the inability to use, these bidding platforms.
9. SEVERABILITY AND WAIVER. If any provision or portion of these Terms of Sale shall be deemed unlawful, void, or unenforceable under applicable law, that provision or portion shall be stricken and severed from the remaining provisions, which shall remain in full force and effect. Failure to enforce any of the provisions in these Terms of Sale shall not be deemed a waiver of the right to enforce any other provisions of these Terms of Sale.
Autopay
If you have not contacted Himalayan Specialties to arrange payment within 3 days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice.
SALES TAX
